The council have a legal duty of care to protect the public, and therefore they have the right to enforce repairs to any structure that is unsafe. Only the courts have a right to fine someone, however the council may undertake the work and then invoice you for the work, and subsequently issue a summons for non-payment if you refuse to do so, or alternatively issue a fixed penalty notice, which is not a fine, in the same way that a parking or speeding ticket is not a fine.
