He said he did not lodge 03 04 tax return. if ATO asked him to lodge, it means he had income but did not lodge.

individual 5 years is that you have already lodged your tax return, but ATO has 5 years to review/audit your previous years tax returns usually, but if there is an issue, could be more than 5 years.
